Terms of service

Welcome to SmilePlax. These Terms of Service ("Terms") govern your use of smileplax.com (the "Site") and your purchases from SmilePlax ("SmilePlax", "we", "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or use the Site with the involvement of a parent or legal guardian. You agree to give accurate and complete information when you place an order.

2. Products and product information

We try to describe and show our products accurately. Colors can look slightly different on different screens, and packaging may change. Illustrations on the Site (for example, before/after illustrations) are for explanation only and do not show guaranteed results; results depend on your own brushing routine.

Our products are personal-care products. They are not intended to diagnose, treat, cure or prevent any disease, and nothing on the Site is medical or dental advice. If you have a dental condition, ask your dentist before using an electric toothbrush.

3. Safe use

• Use the product only as described in its instructions.
• Children should use the product only under adult supervision.
• Stop using the product and consult a professional if you notice pain, bleeding or irritation.
• Only charge the product with the charging base supplied, do not use a damaged charger or cable, and keep the charging base away from water other than as the instructions allow.
• The product contains a rechargeable battery. Do not open, puncture or burn it, and recycle it according to your local rules.

4. Prices and availability

Prices are shown in U.S. dollars. Shipping costs and any applicable taxes are shown at checkout before you pay. We may change prices, promotions and availability at any time, but a change will not affect an order we have already accepted. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and fully refund any amount you paid.

5. Orders

Your order is an offer to buy. The order confirmation email confirms that we received your order; we accept it when we ship it. We may refuse or cancel an order (for example, for suspected fraud, payment problems, or items we cannot supply). If we cancel an order you paid for, we will refund you in full to your original payment method.

6. Payment

You confirm that you are authorized to use the payment method you provide. Payments are processed by our payment processors; we do not store your full card details.

7. Shipping

Shipping is described in our Shipping Policy. Delivery times are estimates. If we cannot ship within the time we promised, we will tell you and give you the option to cancel for a full refund, as described in the Shipping Policy. Risk of loss passes to you when the carrier delivers the package to the address you provided.

8. Returns and refunds

Returns and refunds are described in our Refund Policy, which is part of these Terms.

9. Payment disputes

If there is a problem with your order, please contact us first at support@smileplax.com — we can usually solve it faster than a chargeback. This does not limit any right you have to dispute a charge with your card issuer or payment provider. We may share order, delivery and communication records with the payment provider to respond to a dispute.

10. Promotions and discount codes

Promotions and discount codes are subject to the conditions shown with them. Unless stated otherwise, they cannot be combined and have no cash value. We may cancel orders that misuse promotions (for example, by using fake accounts).

11. Reviews and content you send us

If you send us a review, photo or comment, you confirm it is your own, honest experience and that you have the right to share it, and you allow us to display it on the Site and in our marketing. We show reviews from real customers only, we do not change their meaning, and we do not hide reviews because they are negative. We may remove content that is unlawful, abusive, or unrelated to the product.

12. Intellectual property

The Site's content, including text, logos, graphics, images and design, belongs to SmilePlax or is used with permission from its owners, and is protected by intellectual property laws. You may not copy or reuse it without our written permission. Product and company names of third parties mentioned on the Site belong to their respective owners.

13. Acceptable use

You agree not to use the Site for unlawful purposes, try to access our systems without permission, interfere with the Site's security or operation, scrape the Site with automated tools without our permission, or submit false claims, fraudulent refund requests or fraudulent chargebacks.

14. Warranties

Apart from what is stated in our Refund Policy and any rights you have under applicable law, the Site and products are provided "as is", to the extent permitted by law. Some states do not allow the exclusion of implied warranties, so some of these exclusions may not apply to you.

15. Limitation of liability

To the extent permitted by law, SmilePlax is not liable for indirect, incidental, special or consequential damages, and our total liability for any claim related to a product is limited to the amount you paid for that product. Some states do not allow these limitations, so they may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud or for injury caused by our negligence where the law does not allow it to be limited.

16. Indemnification

To the extent permitted by law, you agree to cover reasonable losses and costs we suffer because you broke these Terms, misused the Site, or violated someone else's rights.

17. Your rights as a consumer

Nothing in these Terms takes away any right you have under consumer protection laws that cannot be waived, including the laws of the U.S. state where you live.

18. Governing law and disputes

These Terms are governed by the laws that apply to SmilePlax's business, without regard to conflict-of-law rules, but you keep the protection of any mandatory consumer laws of your state of residence. If a dispute arises, please contact us first so we can try to solve it informally. You may also bring an individual claim in a small claims court that has jurisdiction.

19. Accessibility

We want the Site to be usable by everyone. See our Accessibility Statement or email us if you need help placing an order.

20. Privacy

Our Privacy Policy and Cookie Policy explain how we handle personal information.

21. General

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms, together with the policies linked above, are the entire agreement between you and SmilePlax about the Site and your purchases. You agree that we may communicate with you electronically, for example by email. We may update these Terms; the version posted when you place an order applies to that order.
